DMCA & copyright policy

How to report content you believe infringes your copyright, how to respond if your content was removed, and what happens to repeat infringers.

Designated agent

Where to send a notice.

Notices of claimed infringement under 17 U.S.C. § 512(c) go to our designated agent, Copyright Agent, Headband, Inc., at dmca@hdbnd.com, or through the form on this page. The agent's postal address is the one listed in the U.S. Copyright Office DMCA Designated Agent Directory for Headband, Inc.

What a notice must include

The six elements of a valid notice.

Your physical or electronic signature; identification of the copyrighted work; the URL(s) on hdbnd.com where the material appears; your name, postal address, telephone number and email; a good-faith statement that the use is not authorized; and a statement under penalty of perjury that the notice is accurate and that you are the owner or authorized to act for the owner. Knowing misrepresentation carries liability under 17 U.S.C. § 512(f).

Counter-notice and repeat infringers

If your content was removed.

Send a counter-notice to the same agent with your signature, identification of the removed material, a statement under penalty of perjury that it was removed by mistake or misidentification, your contact details, and consent to jurisdiction. Unless the complaining party files a court action within 10 business days, we may restore the material within 10 to 14 business days. We terminate the accounts of repeat infringers in appropriate circumstances.
